Terms of Service

1. Introduction

The following document applies to Trustap’s transaction platform (www.trustap.com) (“The Platform”).

The Platform is owned and operated by Trustap Ltd (“Trustap”), a Private Limited Company incorporated in Ireland. Trustap grants you a non-exclusive licence to access the Platform and use the Services subject to these terms and conditions (“Terms”). By accessing and using the Platform and Services, you agree to be bound by these Terms.

“Trustap Account”

The registered profile of a Customer. “The Trustap Hold” refers to Trustap’s Stripe Platform Account, a safeguarded Hold Account, protecting Customer funds even in insolvency.

“Account”

(i) A payment account or instrument of a Buyer held with a third-party provider; (ii) A payment account of a Seller held with a third-party provider where funds are transferred from the Trustap Hold.

“Business Day”

Monday through Friday between 9:00 a.m. and 5:00 p.m. (GMT), excluding public holidays in Ireland.

“Payment”

The transfer of Funds by Trustap from the Buyer to the Seller for the relevant Transaction.

“Funds”

The funds transferred to the Trustap Hold for the purpose of effecting the Payment of the Transaction between Buyer and Seller.

“Transaction ID”

A unique identifier associated with a specific Payment Transaction.

“Prohibited Transactions”

Customers may not use the Platform for illegal transactions or those involving prohibited items.

“Security Details”

The username or password associated with your Trustap Account.

“Seller”

As defined in paragraph 5.1(a) of these Terms.

“Services”

The transaction management and escrow-like services provided in relation to the Trustap Hold.

“Buyer”

As defined in paragraph 5.1(a) of these Terms.

“Writing”

Includes emails.

“Transaction”

The sale of goods or services by the Seller to the Buyer.

“Item”

The object of the transaction, which must not be part of the Prohibited Transactions list.

2. Conditions of Use

You accept that to access and use the Platform and any Services, you must be over the age of 18 and not engage in Prohibited Transactions. You must provide accurate information and not share it with others.

3. Registration & Accounts

To access the services, you must register a Trustap Account by providing necessary information and creating a password. You agree to provide any information required for verification.

If required Security Details are shared fraudulently, you indemnify Trustap for any resulting loss or damage. Trustap may suspend your account under certain circumstances, and you agree to notify Trustap of any changes in your information.

4. Other Service Providers

Stripe

Payment processing services are provided by Stripe, subject to their Connected Account Agreement. You must provide accurate information and authorize Trustap to share relevant details.

Aftership

Delivery tracking services are provided by Aftership, subject to their Privacy Policy and Terms.

5. Transactions

To initiate a Transaction, a Customer must log into their Trustap Account and confirm the details. After the Buyer transfers funds to the Trustap Hold, the funds will not be released until the transaction is completed. If any delays occur, Trustap will notify you as applicable.

Payment & Fees

Payments must be made in advance, and fees are subject to change. Various fees include the Buyer Protection Fee, Seller Fee, and Charges for International Transactions or Chargebacks.

Cancelling a Transaction

If the Transaction is not completed, a Buyer can lodge a complaint via the Platform. A mutually agreed cancellation may occur with applicable Charges.

Consumer Protection

Sellers must comply with all applicable regulations regarding cancellations, refunds, and returns as per the jurisdiction.

6. Liabilities And Liability For Invalidated Payments

Trustap is only liable for specific circumstances such as fraud or negligence. Sellers are liable for any Invalidated Payments.

7. Payout details

Ensure your personal details and payout methods are current. Funds may be withheld if there are inconsistencies.

8. Notices & Communication

Contact Trustap through the designated channels. All communications will be conducted in English.

9. Termination

Either party can terminate these Terms. Ongoing Transactions will continue unless otherwise agreed.

Cooling-off: Consumers acknowledge losing the right to withdraw once services are delivered.

10. Disputes, Refunds and Returns

Trustap takes on the role of Merchant of Record but does not engage directly in final sales. Dispute resolution policies govern order issues and complaints, specifically with regard to Buyer Protection.

11. Complaints and ADR

Contact Trustap for complaints regarding Services, with full cooperation required for resolution.

12. Privacy Policy & Cookie Policy

You accept the Privacy Policy and Cookie Policy provided by Trustap.

13. Force Majeure

Trustap is not liable for breaches due to unforeseen circumstances beyond control.

14. General

For questions, contact Trustap for clarifications on Terms. Updates or modifications to Terms will be notified, and your continued use constitutes acceptance of those changes.
